I don't understand much about legal matters but to me it looks like the removal of DRM issue is only being used as "leverage" here. To obtain the Xbox distribution of the game, now that they figured the XBox version will probably make lots of money, possibly more than the PC vesrion. It's not like they would have brought up the DRM issue in court if CDPR didn't chose a new distributor, NB made money with this game and DRM remval probably helped a lot.

Witcher 2, a very good game and it also doesn't have DRM.
A "win win" situation by any means to us, the consumers who have brought the game because between performance and compatibility; the game is running fine with DRM slowdowns(which is actually crippling the game).
No DRM, Consumers happy and game developers happy..what the FUCK is Namco Bandai doing in between.
I also think the people who brought Namco Bandai's copies of Witcher 2 should send mails and return the DVD's back to them saying them to keep the DAMN shit with them.
Right now, I am downright persuaded and switched to the other side because of what Namco Bandai mentioned...taking DRM as a point to sue a good game developer. I am gonna download DRM'ed games from now ONLY via Torrents. _|_ to DRM games and double _|_ to Namco.
(of course I will buy DRM free games which I like)

Correct. It's basic knowledge and you also need it to calculate other truths...

Kicek11: Not good, according to : http://tnij.org/ms6w the release date of TW 2 Xbox may be threatend, thanks to Namco Bandai. CDPR is suffering losses due to the lawsuit.

Wondering if NB is actually using this as a strategic lawsuit to get the Xbox 360 deal back by undermining THQ.
CD Projekt may be well capitalized, but THQ is hurting. They lost $38.4 million last quarter. That has to make executives think twice about pursuing projects that are being held back by factors that aren't under their control. Maybe NB is using the lawsuit to induce THQ to back out.

I wonder if there was a way to earn more income on PC rather than the Funbox, which will require a whole bunch of 14 yr olds to become interested in TW2. I mean let's be realistic..most console players are knuckle heads, very young knuckle heads...and CDPR hopes to sell their highly complex RPG to these kids?....Really?

[troll]Hey, not EVERYONE who plays console games is a 12 year old, despite what Cowadoody voice chat seems to suggest. I know plenty of mentally handicapped adults that play on Xbox Live. [/troll]
Despite that, I hope TW2 does well on consoles but TW3 DOESN'T suffer for it. I mean, TW2 clearly suffered in a number of ways from consolization but overall I think it was improved...I just don't want to see TW3 become Dragon Age 2. Or even Mass Effect 2. Improved GUI's like in the first game and less character development - story segregation would be nice (In other words, I'd prefer if character development changed something more than just combat, like how you could spend talent points to identify new herbs in TW1...or maybe if you could put points into Axii to open up new conversation options).
